Terms of Use
These terms cover your use of the V8 PitWall iOS app and the v8pitwall.com website (together, "the service"). By installing or using the app, you agree to them. If you don't agree, please don't use the service.
1. Who we are
V8 PitWall is operated by BX Precision Engineering (ABN 14 181 476 494), based in Australia.
2. The licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use V8 PitWall on Apple devices you own or control, in accordance with Apple's standard end-user licence agreement and these terms. You may not redistribute the app, reverse engineer it, or use it to build a competing product.
3. Apple's standard EULA
Apple's standard Licensed Application End User License Agreement also applies to your installation of V8 PitWall. To the extent of any inconsistency between Apple's EULA and these terms, Apple's EULA prevails for matters relating to the app itself.
4. PitWall Pro subscriptions and purchases
The free tier is, well, free. PitWall Pro is offered as:
- Annual subscription — A$12.99 per year, auto-renewing through your Apple ID until cancelled. Renewals are charged within 24 hours of the period ending. You can manage or cancel at any time in Settings → Apple ID → Subscriptions.
- Lifetime — A$39.99, one-time purchase via the App Store. Entitles you to PitWall Pro features for the life of the app on accounts under the same Apple ID, subject to Apple's terms.
Prices are shown in Australian dollars. Apple converts to local currency at the store rate where applicable. Apple may also vary tax treatment by region.
5. Refunds
All purchases are processed by Apple. Refund requests must be made directly to Apple via reportaproblem.apple.com. We do not process payments or refunds. Nothing in these terms limits any non-excludable rights you have under the Australian Consumer Law or equivalent local law.
6. Data accuracy and availability
V8 PitWall aggregates information from public sources including supercars.com, Speedcafe, Motorsport.com and Wikipedia. We make reasonable efforts to keep the data accurate and up to date, but we can't guarantee it. Session times, results, standings and the Finals projection are provided "as is", may lag, and should not be relied on for betting, attendance or any other decision with real consequences. Always confirm critical information directly with the official source.
We may change, suspend or discontinue any part of the service at any time without notice. Push notifications depend on Apple's network and your device settings and may be delayed or missed.
7. No affiliation with Supercars
V8 PitWall is an independent, unofficial app. It is not produced, endorsed, sponsored or affiliated with Supercars Australia, the Repco Supercars Championship, the Bathurst 1000, any racing team, driver or sponsor. "Supercars", "Repco Supercars Championship", "Bathurst 1000" and team names are trademarks of their respective owners and are used only for descriptive identification.
8. Acceptable use
You agree not to:
- Use the service in any way that breaches applicable law.
- Attempt to gain unauthorised access to the backend or to scrape it at a rate that disrupts other users.
- Strip, hide or work around the unofficial-affiliation notices, app credits or licence terms.
9. Liability
To the maximum extent permitted by law, we exclude all warranties not expressly stated here, and our liability for any claim arising out of or relating to the service is limited to (at our option) re-supplying the service or refunding the amounts you've paid us in the 12 months before the claim. We are not liable for any indirect, consequential or special loss.
Nothing in these terms excludes or limits any guarantee, warranty, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
10. Termination
You can stop using V8 PitWall at any time by deleting the app. We may suspend or terminate your access to backend services if you breach these terms or if continued operation isn't viable. If we terminate without cause and you've prepaid for time you haven't used, we'll work with Apple to refund the unused portion.
11. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state and the federal courts of Australia.
12. Changes
We'll update these terms from time to time. The "Last updated" date at the top reflects the current version. Continuing to use the service after a change means you accept the updated terms. Material changes will be highlighted in the app's release notes.
